Prosecutor Absence Stalls Fayose Trial

Proceedings in the ongoing trial of former governor of Ekiti, Ayodele Fayose at a Federal High Court in Lagos, was on Tuesday adjourned due to the absence of counsel to the Economic and Financial Crime Commission, EFCC.

Presiding judge, Justice Mojisola Olatoregun adjourned further hearing until May 21.

Ayodele Fayose is standing trial for an alleged N6.9 billion fraud preferred against him by the EFCC.

When the case was first called at 1.00 p.m, it was stood down for one hour by Justice Olatoregun, to enable the prosecutor, Mr Rotimi Jacobs, SAN, catch up with proceedings.

However, when at the expiration of the hour, and still Jacobs did not turn up, the court adjourned the case until May 21, for continuation of trial.

Recall that Fayose was arraigned on an 11 counts charge in October 2018, by the anti-graft body alongside a company, Spotless Investment Ltd.

He had pleaded not guilty to the charges, and was granted bail in the sum of N50 million with one surety in like sum.

At the last adjourned date on May 10, the prosecutor had sought for an adjournment of the case, after it informed the court that its 13th witness, Adewale Aladegbola, had turned “hostile” in his testimony.
The witness had during his testimony contradicted his earlier statement to the EFCC.
When the case was called on Tuesday, Messrs Ola Olanipekun, SAN, and Olalekan Ojo, SAN, announced appearances for the defendants.

They informed the court that the prosecutor was absent and had not written any letter to them, and urged the court to stand down the case for some time, to enable prosecutor attend court.

The matter was subsequently adjourned when the prosecutor failed to turn up following the stand down.
