Court sets over 100 Shiite members free, govt threatens to file appeal

No fewer than 100 members of the Islamic Movement in Nigeria (IMN) otherwise referred to as Shiite were freed on Tuesday by a Kaduna State High Court.

They were freed on Tuesday by Justice Shiri Nyom, following “lack of enough evidence” against them.

The freed persons were arrested and detained since 2015 following a clash between the group and the Nigerian Army in the state.

The clash left many people dead.

The charges against them by the Kaduna State government include unlawful assembly, conspiracy and culpable homicide.

Not pleased with the verdict, however, Kaduna State government has said it would file an appeal.

Said Hajiya Hikima, Kaduna State Attorney General:  “In prosecuting the case, the State called 47 witnesses and tendered several exhibits. The prosecution believes that a compelling case was argued. Therefore, an appeal will be filed to challenge the ruling of the court.

“Despite the quality of evidence placed before the honourable court, it ruled in favour of the accused persons.

“The Kaduna State government hereby states that it is totally dissatisfied with the ruling which it view as perverse and totally lacking in merit and shall appeal immediately to the Kaduna judicial division of the court of appeal.”
