The Economic and Financial Crimes Commission on Thursday said it would appeal the judgment of the Federal High Court, Ikoyi, Lagos, which discharged and acquitted former aide of ex-President Goodluck Jonathan on Domestic Affairs, Waripamo-Owei Dudafa, and a banker, Joseph Iwuejo, who were charged with N1.6bn fraud.
Justice Muhammed Idris had earlier on Thursday acquitted the duo on the ground that the prosecution failed to prove its case against them beyond reasonable doubt.
He said though the prosecution tried its best, it failed to call vital witnesses in the case.
The judge also held the EFCC based its case on suspicion and assumptions rather than legal findings.
Consequently, he dismissed all the 22 counts against the defendants.
However, the Commission in a statement by its spokesman, Wilson Uwujaren, said it was studying the details of the judgment and would approach the appeal court for a review.
The commission had arraigned the defendants for money laundering, conspiracy and concealment to the tune of N1.6bn.
