A Lagos Division of the Federal High Court, on Tuesday, dismissed the charges against former Governor of Enugu State, Chimaroke Nnamani, because there were no proper charges before it.
According to the judge, Chuka Obiozor, the court had entered judgement in the same suit by Justice Mohammed Yunusa of another judge
Nnamani is being prosecuted by the Economic and Financial Crimes Commission, EFCC, for alleged money laundering to the tune of N4.5 billion.
He was said to have committed the office between 1999 and 2007 when he was governor.
The decision to dismiss the charges against Nnamani followed the information by his lawyer, Rickey Tarfa, that a motion had been filed to the effect that the same case had been put to rest by Mr. Yunusa in his judgement suit no FHc/L/09c/07.
In the suit, Tarfa said, parties in the suit had entered a plea bargain before Mr. Yunusa and there was no valid pending charges before Obiozor.
He argued that the court could not sit on appeal for the case of another judge of concurrent jurisdiction.
Dismissing the case in view of the argument canvassed, Obiozor ruled: “I agree that in view of the plea bargain judgement of this court delivered on the 7th of July, 2015, that there is no valid charge before me and I thereby expunge the entire proceedings before me.”
